TERM AND CONDITIONS
1. Introduction
These Terms and Conditions represent the agreement between you and Fizo Kare Physiotherapy and Rehabilitation Centre for the provision of services and constitute a binding agreement between the parties. Therefore, please read and understand these Terms and Conditions as they will govern our relationship.
2. Treatment and Service Delivery
Treatment sessions will be performed on-site or as a home visit by Fizo Kare Physiotherapy and Rehabilitation Centre and its employees.
"Fizo Kare Physiotherapy and Rehabilitation Centre," "Fizo Kare," "us," "we," and "our" means Fizo Kare Physiotherapy and Rehabilitation Centre.
"Client," "you," and "your" means a client that will receive treatment sessions.
3. Full Medical Disclosure
You warrant that all health information you provide to Fizo Kare Physiotherapy and Rehabilitation Centre is accurate, complete, and truthful to the best of your knowledge. You understand that any failure to provide accurate and truthful health information may result in the therapist's inability to provide safe and effective treatment and may therefore be grounds for termination of the treatment session.
You agree to disclose any future medical conditions and/or injuries to your therapist as soon as possible, as it may impact the safety and effectiveness of your treatment. You also acknowledge that your therapist may need to share this information with other healthcare providers involved in your care, but such information will be kept confidential and shared only on a need-to-know basis.
If you reside in an aged care facility, you acknowledge that staff members of Fizo Kare Physiotherapy and Rehabilitation Centre may need to access your medical history to provide safe and effective treatment, subject to the facility's approval. Such information will be kept confidential and shared only on a need-to-know basis.
In the event that your medical condition changes during treatment, your therapist may need to adjust your treatment plan or refer you to other healthcare providers. Your therapist will discuss any necessary changes with you and obtain your consent before proceeding with any modifications to your treatment plan.
4. Fee Schedule
Fizo Kare Physiotherapy and Rehabilitation Centre charges a fee for each treatment session. The fee is payable at the time of the session.
Refunds for physiotherapy sessions are generally not available. However, in cases where the services have not been provided with reasonable care and skill or are not in accordance with the agreed-upon terms and conditions, we will assess your concerns and offer a suitable remedy, which may include a partial or full refund. The refund will be subject to applicable laws and regulations. Please note that we may require proof of purchase, such as the original receipt, to process any refunds.
If you have purchased a package, you agree to pay the full package price at the time of the first treatment session. If you decide to cancel the package before completion, you may be entitled to a partial refund of the remaining sessions, subject to the applicable laws and regulations.
5. Product Refund
If you have purchased any products from Fizo Kare Physiotherapy and Rehabilitation Centre, you may be entitled to a refund in accordance with the Malaysian Consumer Rights Law. To be eligible for a refund, the product must be returned within 7 days of purchase with a valid original receipt and be in its original condition. Fizo Kare Physiotherapy and Rehabilitation Centre reserves the right to refuse a refund if the product is not returned in its original condition. If the refund is approved, the amount refunded will be the purchase price of the product, minus any shipping or handling fees.
6. Clinic Usage
Fizo Kare Physiotherapy and Rehabilitation Centre expects all clients to treat the clinic's property with respect and care. Any negligent or deliberate damage to property will result in suspension or cancellation of the treatment session or package, and you will be liable to pay for the damages. In addition, any behaviour that poses a threat to the safety or well-being of the clinic's property, staff, or other clients may result in immediate termination of the treatment session or package, and you will be liable for any damages incurred. You or your companion(s) must not behave violently, rudely, or in a manner that distresses or causes discomfort to other members of the clinic, clinic staff, or other clients. Any form of harassment or discrimination based on race, gender, sexual orientation, religion, or any other characteristic is strictly prohibited and may result in immediate termination of the treatment session or package.
Smoking and vaping are strictly prohibited in any part of Fizo Kare Physiotherapy and Rehabilitation Centre. Additionally, possession of alcohol, narcotics, or other mood-altering substances is not allowed on the premises, nor is the use of our services under the influence of any of these substances. Any violation of this policy may result in immediate termination of the treatment session or package.
You must keep your personal belongings secure on your person or in a designated location with your therapist while in Fizo Kare Physiotherapy and Rehabilitation Centre. You assume full responsibility for your belongings, and Fizo Kare Physiotherapy and Rehabilitation Centre is not liable for any loss, damage, or theft of personal property. The clinic recommends that you do not bring valuable items with you and that you keep your personal belongings under your supervision at all times.
7. Cancellation Policy
We understand that there may be times when you need to cancel or reschedule your appointment with Fizo Kare Physiotherapy and Rehabilitation Centre. To avoid being charged a cancellation fee, please provide us with at least 24 hours' notice before the scheduled session starting time. If you cancel your appointment within 24 hours of the scheduled session or are not available within 15 minutes of the scheduled session start time, a cancellation fee will be charged to your account. The amount of the fee will depend on the specific circumstances of your cancellation and will be determined at our discretion. This fee will be charged to the payment method we have on file for you.
Please note that this policy applies to all clients, including Private, Worker's Compensation, and Enhanced Primary Care clients, who are responsible for paying the full cost of the scheduled appointment.
If you have purchased a package and decide to cancel before completion, you may be entitled to a partial refund of the remaining sessions, subject to the applicable laws and regulations.
8. Data Collection
During your treatment sessions at Fizo Kare Physiotherapy and Rehabilitation Centre, we may collect and use your personal data in accordance with the applicable laws and regulations. Fizo Kare Physiotherapy and Rehabilitation Centre will use your personal data solely for the purpose of providing the agreed-upon services, and will not disclose or share your personal data with any third party without your consent, except as required by law.
9. Limitation of Liability
Fizo Kare Physiotherapy and Rehabilitation Centre will make every effort to provide high-quality services, but we cannot guarantee the effectiveness of our treatments or be held responsible for any damages that may arise from their use. Our liability is limited to the cost of the treatment session. By accepting our services, you acknowledge that Fizo Kare Physiotherapy and Rehabilitation Centre is not liable for any direct, indirect, incidental, or consequential damages, except as required by law. This provision does not limit our liability for any injury caused by our gross negligence or intentional misconduct.
10. Indemnity
You agree to indemnify and hold Fizo Kare Physiotherapy and Rehabilitation Centre, its officers, directors, employees, agents, and affiliates, harmless from and against any and all claims, demands, suits, actions, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with your use of our services, including but not limited to any injury or damage you may cause to others, any breach of these Terms and Conditions, or any violation of applicable laws and regulations.
This indemnification shall extend to any and all losses, damages, costs, and expenses incurred by Fizo Kare Physiotherapy and Rehabilitation Centre, including but not limited to legal fees, settlements, or judgments.
To make a claim for indemnification, you must provide written notice to Fizo Kare Physiotherapy and Rehabilitation Centre promptly upon becoming aware of any claim or potential claim. Failure to provide prompt notice may result in a waiver of your right to indemnification.
This indemnification shall not apply to any claims or damages arising from intentional misconduct or gross negligence on the part of Fizo Kare Physiotherapy and Rehabilitation Centre.
Any disputes arising out of or in connection with this indemnity shall be governed by the laws of the jurisdiction where Fizo Kare Physiotherapy and Rehabilitation Centre is located, and the parties agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction where Fizo Kare Physiotherapy and Rehabilitation Centre is located. Any disputes arising out of or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
12. Modification of Terms and Conditions
Fizo Kare Physiotherapy and Rehabilitation Centre reserves the right to modify these Terms and Conditions at any time without prior notice. Any such modification will be effective immediately upon posting on our website. By continuing to use our services after any modification, you agree to be bound by the modified Terms and Conditions.
